Terms and Conditions

 

Homi provides a subscription streaming service that allows our users to access entertainment content in the form of movies and lifestyle shows over the internet. 

These terms and conditions govern your use of our service. As used in these terms and conditions ‘’our service’’, ‘’Homi service’’  or ‘’the service’’ refers to all the services that Homi provides to you enabling you to discover and access its content, features and functionalities, user interfaces and software. 

 

 

Membership / Account: 

 

1.1 In order to use certain features of the Homi service, you must register for an account. You may be asked to provide a password in connection with your account. You are solely responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password. 

 

1.2 The information you provide to Homi, whether at registration or at any other time, will be true, accurate, current, and complete. You should also ensure that this information is kept accurate and up-to-date at all times. If you have reason to believe that your account is no longer secure (e.g., in the event of a loss, theft or unauthorized disclosure or use of your account ID or password), then you should immediately notify Homi at support@homitv.com. You may be liable for the losses incurred by Homi or others due to any unauthorized use of your account.

 

Billing and Cancellation

2.1 Billing

You will  be charged a fee to be able to access the Homi service.  After your initial seven (7) days free trial period has been exhausted, billing will occur. The billing will depend on the subscription package you select. The Homi membership fee and any other fee you will be charged such as taxes and or transaction fees will be charged to the payment method you add. The length of your subscription cycle will depend on the subscription package you choose during signup to the Homi service. 

 

2.2 Payment Method

To use the Homi service, users must add a payment method to be able to pay for the selected subscription package. By adding a payment method, you authorize Homi to deduct the subscription fee from the account linked to the payment method. Homi reserves the right to suspend a user’s access to the service when payment fails due to insufficient funds, card expiration and any other reason that may cause subscription payment not to be settled successfully. Users may have to check with their payment service provider for all fees associated with the payment method they add. 

 

2.3 Updating Your Payment Method 

You can update your payment method by going to the ‘My Account’ page to add a new payment method. You authorize Homi to continue charging the selected subscription fee from the account linked to the new payment method you add. 

2.4 Cancellation 

You can cancel your Homi subscription at anytime. To cancel, you can go to the ‘Settings’ page and follow the instructions to cancel. A user may not receive a refund from Homi after such cancellation. After canceling your subscription, you  may continue to have access to the Homi service  through to the end of the paid subscription billing period. 

 

2.5 Changes to Subscription Plans and Pricing

Homi may from time to time make changes to its subscription plans and pricing. Any change to your subscription plan and fee will take effect no earlier than thirty (30) days after you have been notified of such change. 

 

 

Proprietary Materials & Licenses

 

3.1 Proprietary Materials:

 

The service  is owned and operated by HomiTV, Inc. The visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), software, content, educational videos and all other elements of Homi  are protected by international copyright, patent, and trademark laws, international conventions, and other applicable laws governing intellectual property and proprietary rights. 

 

 

3.2 Licensed Content

Homi may make available on its service videos and related supplementary materials that are owned by Homi or its third-party licensors. 

 

Homi grants you a non-exclusive, non-transferable right to access and use the content as made available on the service solely for your personal, non-commercial purposes. Unless expressly indicated on the service that a particular item of Licensed Content is made available to Users under other license terms, you may not distribute, sell, lease and modify the licensed content on the Homi platforms. 

 

3.3 Other Licenses:

 

In certain cases, Homi or its licensors may make available licensed content under other license terms. By using, downloading, or otherwise accessing such licensed content, you agree to comply fully with all the terms and conditions of such other license.

 

 

 

Termination

 

4.1 Termination by Homi:

 

Homi, in its sole discretion, for any or no reason, and without penalty, may terminate any account (or any part thereof) you may have with Homi or your use of the streaming platforms and remove and discard all or any part of your account, User profile, and User Content, at any time. 

 

Homi may also in its sole discretion and at any time discontinue providing access to its service, or any part thereof, with or without notice. You agree that any termination of your access to the service  or any account you may have, or portion thereof, may be affected without prior notice, and You agree that Homi will not be liable to you or any third party for any such termination. Any suspected fraudulent, abusive or illegal activity on the part of users may be referred to appropriate law enforcement authorities. 

 

These remedies are in addition to any other remedies Homi may have at law or in equity. As discussed herein, Homi does not permit copyright, trademarks, or other intellectual property infringing activities on the service, and will terminate access to the service, and remove all User Content or other content submitted, by any Users who are found to be repeat infringers.

 

 

4.2 Termination by You:

 

If you are dissatisfied with (i) the Homi service, (ii) any term of these Terms of Service, (iii) Guidelines, (iv) any policy or practice of Homi in operating its platforms, or (v) any content or information transmitted through its  platforms, you can terminate your account. You may terminate at any time by deleting your login account with the service and discontinuing use of any and all parts of the service.

 

 

Prohibited Conduct:

 

You Agree Not To:

 

5.1 Use the Homi service for any commercial use or purpose unless expressly permitted by HomiTV, Inc.  in writing, it being understood that the Homi service and related services are intended for personal, non-commercial use only;

 

5.2 Impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the  accounts of others without permission, or perform any other fraudulent activity on Homi;

 

5.3 Delete the copyright or other proprietary rights notices on the service or on any licensed content, licensed code, or user content;

 

5.4 Assert, or authorize, assist, or encourage any third party to assert, against Homi or any of its affiliates or licensors any patent infringement or other intellectual property infringement claim regarding any licensed content, licensed code, or user content You have used, submitted, or otherwise made available on Homi;

 

5.5 Make unsolicited offers, advertisements, proposals, or send junk mail or spam to other Users of the Homi service (including, but not limited to, unsolicited advertising, promotional materials, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures);

 

5.6 Use the Homi service for any illegal purpose, or in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy;

 

5.7 Defame, harass, abuse, threaten or defraud Users of the Homi service, or collect, or attempt to collect, personal information about Users or third parties without their consent;

 

5.8 Remove, circumvent, disable, damage or otherwise interfere with security-related features of the Homi service, licensed content, licensed code, or user content, features  that prevent or restrict use or copying of any content accessible through the Homi platforms, or features that enforce limitations on the use of the Homi;

 

5.9 Reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the service  or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;

 

5.10 Modify, adapt, translate or create derivative works based upon the Homi service or any part thereof, except and only to the extent expressly permitted by Homi herein or to the extent the foregoing restriction is expressly prohibited by applicable law;

 

5.11 Intentionally interfere with or damage operation of the Homi service or any user’s enjoyment of it, by any means, including without limitation by participation in any denial-of-service type attacks or by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.

 

Modification of the Terms.

 

6.1 Homi reserves the right, at our discretion, to change, modify, add, or remove portions of the Terms at any time. You may have to check the Terms and Conditions  periodically for changes. Your continued use of the service after the posting of changes constitutes your binding acceptance of such changes.

 

6.2 Notice on Major Changes

 For any major changes to the Terms, Homi will make reasonable effort to provide notice to you by an email notification to the address associated with your account or by posting a notice on its platform. 

 

Such amended terms will be effective against you on the earlier of (i) your actual notice of such changes and (ii) thirty days after Homi makes reasonable attempt to provide you such notice. 

 

6.3 Dispute Resolution

Disputes arising under these Terms will be resolved in accordance with the version of the Terms in place at the time the dispute arose. Homi shall be entitled to make policy declarations from time to time pertaining to matters and may alter the same from time to time at its sole discretion.  All such policy decisions of the service shall be binding on the user and shall override this Agreement to that extent.
